"ONE CALL THAT'S ALL" 107.9 BIRTHDAY BASH CAMPAIGN NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.
1. Eligibility: This "ONE CALL THAT'S ALL" is open only to those who sign up a www.upload.datdistribution.com and those who are age 18 as of the date of entry. The "ONE CALL THAT'S ALL" campaign is only open to legal residents of USA, and is void where prohibited by law. Employees of DATADISTRIBUTION, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the "ONE CALL THAT'S ALL" campaign. The "ONE CALL THAT'S ALL" campaign is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
2. Agreement to Rules: By participating, (“You”) the Contestant agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements are the owner of Your version of the “ONE CALL THAT’S ALL” song and have You the legal right and, or necessary releases in writing from musicians, producers, publishers, vocalist, or lyric writers including ghost writers and music writers, or otherwise to use the music and audio in Your version of the One Call That’s All song. In addition, You agree to accept the decisions of DATADISTRIBUTION, or it’s collaborators as final and binding as it relates to the content of this "ONE CALL THAT'S ALL" campaign.
3. "ONE CALL THAT'S ALL" Campaign Period: Entries will be accepted starting on May 5, 2022 and ending on June 26, 2022. All online entries must be received by June 26, 2022. The top 3 artists with the most streams on DSP platforms and YouTube views combined during the time period of May 5, 2022 and June 26, 2022 of the ONE CALL THAT’S ALL song and 1 additional artist will be selected and announced in the ONE CALL THAT’S ALL-radio commercial, for the general public to call and voice their choice of who they want to see perform ONE CALL THAT’S ALL at the 2022 107.9 Birthday Bash in Atlanta.
4. How to Enter: The "ONE CALL THAT'S ALL" campaign must be entered by submitting an original song titled One Call That’s All using the online music distribution platform provided at www.datdistribution.com. WE SUGGEST WATCHING THE UPLOAD TUTORIAL ON THE UPLOAD PAGE. All entries must also fulfill all DATDISTRIBUTION requirements, as specified on the website and in the distribution agreement, to be eligible to be considered for distribution, to perform, or be a participant. Entries that are incomplete or do not adhere to the rules or specifications, or violate copyright laws may be disqualified at the sole discretion of DATADISTRIBUTION or their Collaborators. From the moment Your song/content is uploaded on the DATDISTRIBUTION platform and the distribution request is done, the Quality Control (QC) will be carried out to detect various issues related to infringement, conflicts, and images deemed as inappropriate by DATDISTRIBUTION and their Collaborators. Once the content has been completely delivered to the selected DSPs, the timing for the publication will depend on each channel. Itt can take from 2 to 15 working days. For this reason, we recommend making the distribution as early as possible, at least 15 days before the release date, to make sure the content will be published on the desired date. Please note that the 2 to 15 working days period is extended during festive and holiday periods, meaning it can take more days for the publication.
5.You may enter only one version of the song: You may not enter “ONE CALL THAT’S ALL” campaign more than one time indicated using multiple email addresses, identities, or devices in an attempt to circumvent the rules. Additionally, if You use fraudulent methods such as fake bots, fake streams, or otherwise in an attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of DATADISTRIBUTION and their collaborators.
6. Prizes: The Winner "ONE CALL THAT'S ALL" campaign will perform at the 107.9 birthday bash, have their song featured in the “One Call That’s All” radio commercial. By entering this "ONE CALL THAT'S ALL" campaign you grant DATDISTRIBUTION and its collaborators the right to use up to 45 seconds of Your “One Call That’s All” song in any configuration for use in radio, tv and social media promotions or otherwise. By uploading Your version of One Call That’s All song you hereby grant worldwide commercial digital distribution to DATDISTRIBUTION per the terms and conditions contained on the DATDISTRIBUTION web site. You will retain 100% ownership of your Masters, 100% of your publishing and song writers and 85% of the streaming royalties. It is Your responsibility to register your "ONE CALL THAT'S ALL" song with the appropriate performing rights organization.
7. Specific Rules for Musical Works and for Recording Artists. If you are a composer or author of a musical work and are affiliated with a PRO, then you must notify your PRO of the royalty-free license you grant through these Terms in your User Content to us. You are solely responsible for ensuring your compliance with the relevant PRO’s reporting obligations. If you have assigned your rights to a music publisher, then you must obtain the consent of such music publisher to grant the royalty-free license(s) set forth in these Terms in your User Content or have such music publisher enter into these Terms with us. Just because you authored a musical work (e.g., wrote a song) does not mean you have the right to grant us the licenses in these Terms. If you are a recording artist under contract with a record label, then you are solely responsible for ensuring that your use of the Services is in compliance with any contractual obligations you may have to your record label, including if you create any new recordings through the Services that may be claimed by your label. The specifics of the prize shall be solely determined by entrant analytics and the radio station listeners. No cash or other prize substitution shall be permitted. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of You the Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for DATADISTRIBUTION to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
8. Odds: The odds of winning depend on the number of eligible entries received, your promotion abilities and the general public choosing you..
9. Winner Selection and Notification: Winner will be selected by analytics. The version of the song that obtains the most legitimate number of DSP streams combined with YouTube views on the DAT YouTube within the time period of May 5, 2022 and June 26, 2022. Winner will be notified by announcement on radio, email or phone. within five (5) days following selection of Winner. DATADISTRIBUTION shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to respond within 48 hours after announcement of the winner from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by Winner of the prize offered in this "ONE CALL THAT'S ALL" campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT DATADISTRIBUTION AND THEIR COLLABORATORS SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE "ONE CALL THAT'S ALL" CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
10. Rights Granted by You: By entering this content (e.g., photo, video, text, etc.), You understand and agree that DATADISTRIBUTION and their Collaborators, anyone acting on behalf of DATADISTRIBUTION, their collaborators and DATADISTRIBUTION and or their Collaborators, and licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the "ONE CALL THAT'S ALL" campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. without any further compensation, notice, review, or consent. By entering this content, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of DATADISTRIBUTION. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless DATADISTRIBUTION and their Collaborators from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which DATADISTRIBUTION may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right. The unauthorized exploitation of any material that is protected by Copyright is prohibited. The use of misleading or fake information (such as artist, band or label names, or artwork which may create confusion or false expectations about the distributed content).The use of any kind of means to generate “clicks” on payment-generating links pretending to be actual consumers. The use of manual or automated resources, bots, or any other means with the intention to stream and monetize any content in streaming DSPs or Fingerprinting Systems (such as YouTube Content ID, Facebook Rights Manager, Soundcloud). Any activity that harms a third party (artist, composer, or producer), as well as a DSP DATDISTRIBUTION or their Collaborators is prohibited.
11. Terms & Conditions: DATADISTRIBUTION and their Collaborators reserves the right, in their sole discretion, to cancel, terminate, modify or suspend the "ONE CALL THAT'S ALL" campaign should virus, bug, non-authorized human intervention, fraud, or other cause beyond DATADISTRIBUTION’s or their Collaborators control corrupt or affect the administration, security, fairness, or proper conduct of the "ONE CALL THAT'S ALL" campaign. In such case, DATADISTRIBUTION and their Collaborators may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by DATADISTRIBUTION. DATADISTRIBUTION reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the "ONE CALL THAT'S ALL" campaign or website or violates these Terms & Conditions. DATADISTRIBUTION and their Collaborators has the right, in their sole discretion, to maintain the integrity of the "ONE CALL THAT'S ALL" campaign, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by "ONE CALL THAT'S ALL" campaign rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the "ONE CALL THAT'S ALL" campaign may be a violation of criminal and civil laws. Should such attempt be made, DATADISTRIBUTION and their Collaborators reserves the right to seek damages to the fullest extent permitted by law.
12. Limitation of Liability: By entering, You agree to release and hold harmless DATADISTRIBUTION and its Collaborators and their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the "ONE CALL THAT'S ALL" campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
13. Disputes: THIS "ONE CALL THAT'S ALL" campaign IS GOVERNED BY THE LAWS OF USA AND Georgia, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this "ONE CALL THAT'S ALL" campaign, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this "ONE CALL THAT'S ALL" campaign, shall be resolved individually, without resort to any form of class action, exclusively by arbitration in Georgia having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this "ONE CALL THAT'S ALL" campaign). Participant further waives all rights to have damages multiplied or increased.
14. Privacy Policy: Information submitted with an entry is subject to the Privacy Policy stated on the DATADISTRIBUTION website.
15. Sponsor: The Sponsor of the "ONE CALL THAT'S ALL" campaign is Ken S. Nugent P.C. Law firm.
16. Facebook: If you use Facebook to communicate or administer a contest or sweepstakes, include the following: The "ONE CALL THAT'S ALL" campaign hosted by DATADISTRIBUTION is in no way sponsored, endorsed, administered by, or associated with Facebook.
17.By clicking the green tab and uploading your music to participate in the "ONE CALL THAT'S ALL" campaign/contest, You, the Contestant, have affirmatively reviewed, accepted, and agreed to all of the Official Rules & Regulations.
18. Payment of Royaltys: It is your responsibility to monitor your royalty and send your invoice requesting payment of royaltys owed to you from DIGITAL STREAMING by emailing DATDISTRIBUTION at dist@datdistribution.com.
